We asked one of our valued customers, <a href=\"https:\/\/www.accountingcafe.co.za\/\">Accounting Cafe<\/a>, to put together a guide on some of the tax implications you need to consider as a small business owner.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-first-things-first-structure-your-business-correctly\">First things first: Structure your business correctly<\/h2>\n\n\n\n<p>Regardless of how big or small your business is, e-commerce or brick-and-mortar, <a href=\"https:\/\/xneelo.co.za\/\">xneelo<\/a> customer Peter Pappas, managing partner at Accounting Cafe, says your first step is to ensure your business structure is in place.&nbsp;<\/p>\n\n\n\n<p>To do this, you need to ask yourself:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Are you trading as a sole proprietor or a company?&nbsp;<\/li>\n\n\n\n<li>What are your forecasted budgets and tax implications for the entity you\u2019ve decided on?&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>If you decide to trade as a sole proprietor or partnership, then open a separate business bank account for trading purposes. \u201cYou cannot use your personal bank account as a business account, regardless of whether you\u2019re a startup or in a partnership.&nbsp;<\/p>\n\n\n\n<p>\u201cAlways keep your business transactions separate from your personal ones \u2013 not doing that could affect admin and create tax challenges going forward.\u201d&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-registering-a-company\">Registering a company<\/h2>\n\n\n\n<p>In his experience, Peter often advises that the business plan will guide your decision to trade as either a sole proprietor or company. \u201cGenerally most startups trade as sole proprietors as there are inherent administration and compliance costs when registering a company. Once your business starts to grow and gain traction \u2013 and you forecast significant growth \u2013 only then should you consider registering and transferring the business into a company.\u201d&nbsp;<\/p>\n\n\n\n<p>For franchisees and larger start-ups, however, the steps are a little different. \u201cWhere there\u2019s a large amount of capital expenditure, the recommendation is usually to start as a company upfront, especially when there are VAT implications and a forecast of significant growth within a 12-month period.\u201d&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-how-to-your-manage-tax-as-an-sme\">How to your manage tax as an SME<\/h2>\n\n\n\n<p>You might be tempted to handle your accounting needs and taxes yourself as a way of saving costs but Peter advises against this. \u201cAppoint a registered tax practitioner and accountant as soon as possible. In addition to managing your books, they can help you structure your business correctly upfront. This eliminates the&nbsp; need to make changes when your business is already trading, which can cause unnecessary complications.\u201d&nbsp;<\/p>\n\n\n\n<p>Peter stresses that it\u2019s imperative to have the right support in place in terms of financial and tax advice. As a business owner, you may need to complete an <a href=\"https:\/\/www.taxtim.com\/za\/blog\/6-reasons-accounting-records-are-critical-to-your-small-business\">annual return for your company<\/a> that provides details relating to your revenue, expenses, deductions, capital gains or losses and any other documentation that will help you manage your personal and business tax.&nbsp;<\/p>\n\n\n\n<p>Good record keeping means you\u2019ll be able to explain what you\u2019ve declared if SARS has any questions about the information you\u2019ve provided. You can do this by keeping digital copies of all <a href=\"https:\/\/www.sars.gov.za\/wp-content\/uploads\/Docs\/SmallBusiness\/Small-business-leaflet-ENG.pdf\">&nbsp;supporting documents<\/a>, such as invoices, receipts, bank deposit slips and expenses.&nbsp;<\/p>\n\n\n\n<p>Use an established <a href=\"https:\/\/www.sage.com\/en-za\/blog\/three-tips-to-avoid-tax-return-penalties\/\">accounting system<\/a> (preferably cloud-based) that will make it much easier to send invoices, track outstanding payments and monitor your expenses. In addition, subscribe to a payroll software if you have employees. This will also create efficiency and structure within your workplace.&nbsp;<\/p>\n\n\n\n<p>There are many cloud-based solutions that are both easy to use and affordably priced. Your accountant can advise on the best one for you.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-the-types-of-tax-you-may-need-to-pay\">The types of tax you may need to pay&nbsp;<\/h2>\n\n\n\n<p>While the tax you\u2019re liable for depends on your business structure, Peter says compulsory tax for most small businesses includes income and provisional tax. \u201cVAT is turnover dependent and you may need to pay PAYE, UIF (Unemployment Insurance Fund) and SDL (Skills Development Levy) if you have employees and are running a payroll system.\u201d&nbsp;<\/p>\n\n\n\n<p><strong>Provisional tax: <\/strong>This isn\u2019t a separate tax from your income tax; instead provisional tax protects you from having to pay one large tax bill. You\u2019ll pay your annual income tax in <a href=\"https:\/\/www.sars.gov.za\/individuals\/i-need-help-with-my-tax\/calendar\/\">three separate installments<\/a>:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>1 August (1st period)<\/li>\n\n\n\n<li>28 February (2nd period)<\/li>\n\n\n\n<li>&nbsp;30 September (3rd period)<\/li>\n<\/ol>\n\n\n\n<p>Your<a href=\"https:\/\/www.sage.com\/en-za\/blog\/a-tax-guide-for-your-first-year-in-business\/\"> first two payments<\/a> are based on an estimation of your taxable income for the period. The third payment is there in case you\u2019ve underestimated and paid too little tax. If you\u2019ve overestimated, on the other hand, you may receive a refund.&nbsp;<\/p>\n\n\n\n<p><strong>Pay-as-you-earn tax (PAYE): <\/strong>By law every employer has to register for <a href=\"https:\/\/www.sars.gov.za\/wp-content\/uploads\/Docs\/SmallBusiness\/Small-business-leaflet-ENG.pdf\">PAYE<\/a> within 21 days after hiring your first employee.
